INTRODUCTORY SUBMISSION &amp; CONSTITUTIONAL CONTEXT<\/strong><\/span><\/h2><ol><li data-start=\"1006\" data-end=\"1303\"><span style=\"color: #000000;\">I, <strong data-start=\"1009\" data-end=\"1039\">Kalle Nagaraja Giri Prasad<\/strong>, S\/o Late Kalle Nagaraju, aged about 54 years, Convenor, <strong data-start=\"1097\" data-end=\"1132\">Victims Rights Protection Trust<\/strong>, Hyderabad, respectfully submit this representation in discharge of a constitutional duty owed to thousands of victims of economic offences across the State of Telangana.<\/span><\/li><li data-start=\"1308\" data-end=\"1672\"><span style=\"color: #000000;\">This is not a routine grievance or individual complaint. It is a <strong data-start=\"1373\" data-end=\"1398\">constitutional appeal<\/strong>, invoking the executive responsibility of the State under <strong data-start=\"1457\" data-end=\"1508\">Articles 14 and 21 of the Constitution of India<\/strong>, and seeking urgent corrective action to arrest a systemic breakdown in investigation, recovery and victim protection in large-scale economic and financial crimes.<\/span><\/li><li data-start=\"1677\" data-end=\"1954\"><span style=\"color: #000000;\">This representation is being submitted <strong data-start=\"1716\" data-end=\"1825\">prior to invoking the extraordinary jurisdiction of the Hon\u2019ble High Court of Telangana under Article 226<\/strong>, so as to afford the State an opportunity to act institutionally and decisively before judicial intervention becomes inevitable.<\/span><\/li><\/ol><h2 data-start=\"1961\" data-end=\"2013\"><span style=\"color: #000000;\"><strong data-start=\"1964\" data-end=\"2013\">II. LOCUS STANDI &amp; PUBLIC INTEREST FOUNDATION<\/strong><\/span><\/h2><ol start=\"4\"><li data-start=\"2018\" data-end=\"2229\"><span style=\"color: #000000;\">The Victims Rights Protection Trust is a public-interest organisation consistently engaged with victims of deposit scams, Ponzi schemes, unregistered chit funds, real-estate frauds and other white-collar crimes.<\/span><\/li><li data-start=\"2234\" data-end=\"2425\"><span style=\"color: #000000;\">Thousands of affected victims, many of whom have lost life savings, retirement benefits, provident funds and borrowed monies, have approached the Trust after exhausting all ordinary remedies.<\/span><\/li><li data-start=\"2430\" data-end=\"2625\"><span style=\"color: #000000;\">The present representation is therefore rooted in <strong data-start=\"2480\" data-end=\"2508\">collective public injury<\/strong>, not private interest, and squarely falls within matters demanding immediate executive and constitutional attention.<\/span><\/li><\/ol><h2 data-start=\"2632\" data-end=\"2692\"><span style=\"color: #000000;\"><strong data-start=\"2635\" data-end=\"2692\">III. ALARMING SURGE OF ECONOMIC OFFENCES IN TELANGANA<\/strong><\/span><\/h2><ol start=\"7\"><li data-start=\"2697\" data-end=\"2940\"><span style=\"color: #000000;\">Telangana has witnessed an unprecedented rise in organised economic offences, including illegal deposit collection schemes, fraudulent investment models, real-estate cheating, cyber-enabled financial frauds and laundering of proceeds of crime.<\/span><\/li><li data-start=\"2945\" data-end=\"3139\"><span style=\"color: #000000;\">These offences are not isolated acts but are <strong data-start=\"2990\" data-end=\"3016\">systematically planned<\/strong>, involving layered transactions, benami structures, family members, close associates and sophisticated diversion of funds.<\/span><\/li><li data-start=\"3144\" data-end=\"3331\"><span style=\"color: #000000;\">The financial magnitude involved runs into <strong data-start=\"3187\" data-end=\"3220\">thousands of crores of rupees<\/strong>, affecting not only individual victims but the financial stability and public confidence in governance itself.<\/span><\/li><\/ol><h2 data-start=\"3338\" data-end=\"3388\"><span style=\"color: #000000;\"><strong data-start=\"3341\" data-end=\"3388\">IV. CRITICAL FAILURE AT THE THRESHOLD STAGE<\/strong><\/span><\/h2><ol start=\"10\"><li data-start=\"3394\" data-end=\"3577\"><span style=\"color: #000000;\">Although FIRs are registered by specialised agencies such as CCS, EOW, CID and local police, the most critical phase of investigation\u2014the <strong data-start=\"3532\" data-end=\"3558\">initial 24 to 48 hours<\/strong>\u2014is routinely lost.<\/span><\/li><li data-start=\"3583\" data-end=\"3781\"><span style=\"color: #000000;\">During this window, when unaccounted cash, documents, digital devices, property records and electronic trails are physically available, <strong data-start=\"3719\" data-end=\"3780\">no mandatory, uniform or coordinated action is undertaken<\/strong>.<\/span><\/li><li data-start=\"3787\" data-end=\"3956\"><span style=\"color: #000000;\">As a result, by the time searches or seizures occur, assets are transferred, evidence destroyed, funds layered or laundered, and recovery becomes practically impossible.<\/span><\/li><\/ol><h2 data-start=\"3963\" data-end=\"4014\"><span style=\"color: #000000;\"><strong data-start=\"3966\" data-end=\"4014\">V. GROUND REALITY OF BLACK MONEY CONCEALMENT<\/strong><\/span><\/h2><ol start=\"13\"><li data-start=\"4020\" data-end=\"4236\"><span style=\"color: #000000;\">It is an undeniable ground reality that <strong data-start=\"4060\" data-end=\"4235\">vast quantities of black money and proceeds of economic crimes are concealed in residences, benami properties and controlled premises of offenders and their family members<\/strong>.<\/span><\/li><li data-start=\"4242\" data-end=\"4407\"><span style=\"color: #000000;\">Delay at the inception stage irreversibly defeats recovery. Once assets are alienated or layered, restitution becomes illusory, regardless of subsequent prosecution.<\/span><\/li><li data-start=\"4413\" data-end=\"4527\"><span style=\"color: #000000;\">This reality necessitates <strong data-start=\"4439\" data-end=\"4526\">immediate, decisive and compulsory action at the very threshold of complaint or FIR<\/strong>.<\/span><\/li><\/ol><h2 data-start=\"4534\" data-end=\"4586\"><span style=\"color: #000000;\"><strong data-start=\"4537\" data-end=\"4586\">VI. MISUSE OF BAIL &amp; CONTINUING VICTIMISATION<\/strong><\/span><\/h2><ol start=\"16\"><li data-start=\"4592\" data-end=\"4682\"><span style=\"color: #000000;\">Accused persons in economic offences routinely secure bail at early stages and thereafter:<\/span><\/li><li data-start=\"4687\" data-end=\"4987\"><span style=\"color: #000000;\">Intimidate and threaten victims and witnesses;<\/span><br data-start=\"4736\" data-end=\"4739\" \/><span style=\"color: #000000;\">b. Coerce complainants into illegal settlements;<\/span><br data-start=\"4790\" data-end=\"4793\" \/><span style=\"color: #000000;\">c. Tamper with digital and documentary evidence;<\/span><br data-start=\"4844\" data-end=\"4847\" \/><span style=\"color: #000000;\">d. Transfer proceeds of crime to family members and benami entities; and<\/span><br data-start=\"4922\" data-end=\"4925\" \/><span style=\"color: #000000;\">e. In several cases, restart similar fraudulent activities.<\/span><\/li><li data-start=\"4993\" data-end=\"5158\"><span style=\"color: #000000;\">Such conduct transforms bail into an instrument of continued criminality, resulting in <strong data-start=\"5080\" data-end=\"5157\">ongoing violation of victims\u2019 right to life with dignity under Article 21<\/strong>.<\/span><\/li><\/ol><h2 data-start=\"5165\" data-end=\"5225\"><span style=\"color: #000000;\"><strong data-start=\"5168\" data-end=\"5225\">VII. INTER-AGENCY FRAGMENTATION &amp; JURISDICTIONAL GAPS<\/strong><\/span><\/h2><ol start=\"18\"><li data-start=\"5231\" data-end=\"5387\"><span style=\"color: #000000;\">There exists no mandatory, institutionalised coordination at the FIR stage among CCS, EOW, CID, ACB, Enforcement Directorate and other specialised agencies.<\/span><\/li><li data-start=\"5393\" data-end=\"5551\"><span style=\"color: #000000;\">This fragmentation allows offenders to exploit jurisdictional boundaries, procedural delays and administrative silos, defeating both prosecution and recovery.<\/span><\/li><li data-start=\"5557\" data-end=\"5646\"><span style=\"color: #000000;\">In economic offences, <strong data-start=\"5579\" data-end=\"5645\">delay and lack of coordination are themselves fatal to justice<\/strong>.<\/span><\/li><\/ol><h2 data-start=\"5653\" data-end=\"5712\"><span style=\"color: #000000;\"><strong data-start=\"5656\" data-end=\"5712\">VIII. INADEQUATE IMPLEMENTATION OF EXISTING STATUTES<\/strong><\/span><\/h2><ol start=\"21\"><li data-start=\"5718\" data-end=\"5974\"><span style=\"color: #000000;\">Despite the presence of statutory frameworks under the Bharatiya Nyaya Sanhita, the Telangana Protection of Depositors in Financial Establishments Act, the Prevention of Money Laundering Act, 2002, and allied laws, enforcement remains sporadic and delayed.<\/span><\/li><li data-start=\"5980\" data-end=\"6126\"><span style=\"color: #000000;\">In the absence of court-monitored, time-bound and coordinated execution, these statutes remain largely ineffective in securing victim restitution.<\/span><\/li><\/ol><h2 data-start=\"6133\" data-end=\"6198\"><span style=\"color: #000000;\"><strong data-start=\"6136\" data-end=\"6198\">IX. NATIONAL JUDICIAL DEVELOPMENTS \u2013 SUPREME COURT CONTEXT<\/strong><\/span><\/h2><ol start=\"23\"><li data-start=\"6204\" data-end=\"6413\"><span style=\"color: #000000;\">A significant writ petition titled <strong data-start=\"6239\" data-end=\"6287\">Sureshkumar &amp; Ors. vs. Union of India &amp; Ors.<\/strong>, concerning an alleged \u20b91,000 crore deposit scam, is presently under consideration before the Hon\u2019ble Supreme Court of India.<\/span><\/li><li data-start=\"6419\" data-end=\"6670\"><span style=\"color: #000000;\">A Bench comprising the Hon\u2019ble Chief Justice of India, Justice Surya Kant and Justice Joymalya Bagchi issued notice on 6 February 2025 and is examining whether large, inter-State economic offences can be effectively investigated by State police alone.<\/span><\/li><li data-start=\"6676\" data-end=\"6833\"><span style=\"color: #000000;\">The proceedings expose systemic investigative failures, prolonged delays, non-recovery of assets and committee-level paralysis, despite judicial supervision.<\/span><\/li><li data-start=\"6839\" data-end=\"7004\"><span style=\"color: #000000;\">The anomaly of <strong data-start=\"6854\" data-end=\"6910\">parallel and fragmented investigations across States<\/strong> has been judicially noticed, directly reinforcing the concerns raised in this representation.<\/span><\/li><\/ol><h2 data-start=\"7011\" data-end=\"7076\"><span style=\"color: #000000;\"><strong data-start=\"7014\" data-end=\"7076\">X. CONSTITUTIONAL NECESSITY FOR IMMEDIATE EXECUTIVE ACTION<\/strong><\/span><\/h2><ol start=\"27\"><li data-start=\"7082\" data-end=\"7254\"><span style=\"color: #000000;\">The above developments demonstrate that <strong data-start=\"7122\" data-end=\"7183\">delay at the threshold stage irreversibly defeats justice<\/strong>, compels courts to intervene belatedly, and leaves victims remediless.<\/span><\/li><li data-start=\"7260\" data-end=\"7403\"><span style=\"color: #000000;\">Uniform, immediate and mandatory executive action is therefore the <strong data-start=\"7327\" data-end=\"7369\">only effective constitutional response<\/strong> to large-scale economic offences.<\/span><\/li><\/ol><h2 data-start=\"7410\" data-end=\"7479\"><span style=\"color: #000000;\"><strong data-start=\"7413\" data-end=\"7479\">XI. CORE EXECUTIVE ACTION SOUGHT (WITHOUT JUDICIAL USURPATION)<\/strong><\/span><\/h2><ol start=\"29\"><li data-start=\"7485\" data-end=\"7767\"><span style=\"color: #000000;\">In the above circumstances, it is respectfully requested that the State of Telangana institutionalise a <strong data-start=\"7589\" data-end=\"7620\">uniform State-wide protocol<\/strong>, mandating that <strong data-start=\"7637\" data-end=\"7729\">within 24 hours of receipt of complaint or registration of FIR in every economic offence<\/strong>, the following actions are initiated:<\/span><\/li><li data-start=\"7772\" data-end=\"8261\"><span style=\"color: #000000;\">Immediate search and seizure operations against accused persons, their family members, close associates and suspected benami holders;<\/span><br data-start=\"7908\" data-end=\"7911\" \/><span style=\"color: #000000;\">b. Seizure, freezing and attachment of unaccounted cash, movable and immovable properties, bank accounts, digital wallets, crypto assets, documents and electronic devices;<\/span><br data-start=\"8085\" data-end=\"8088\" \/><span style=\"color: #000000;\">c. Securing of evidence at the threshold stage to prevent dissipation of proceeds of crime; and<\/span><br data-start=\"8186\" data-end=\"8189\" \/><span style=\"color: #000000;\">d. Protection of victims and witnesses from intimidation or coercion.<\/span><\/li><\/ol><h2 data-start=\"8268\" data-end=\"8318\"><span style=\"color: #000000;\"><strong data-start=\"8271\" data-end=\"8318\">XII. NEED FOR A HIGH-LEVEL EXPERT MECHANISM<\/strong><\/span><\/h2><ol start=\"30\"><li data-start=\"8324\" data-end=\"8568\"><span style=\"color: #000000;\">It is further requested that the State consider constituting a <strong data-start=\"8387\" data-end=\"8418\">High-Level Expert Committee<\/strong> comprising senior police officers experienced in economic offences, representatives of specialised agencies, and financial investigation experts, to:<\/span><\/li><li data-start=\"8573\" data-end=\"8811\"><span style=\"color: #000000;\">Frame constitutionally compliant SOPs for economic offences;<\/span><br data-start=\"8636\" data-end=\"8639\" \/><span style=\"color: #000000;\">b. Ensure coordinated inter-agency action;<\/span><br data-start=\"8684\" data-end=\"8687\" \/><span style=\"color: #000000;\">c. Recommend mechanisms for victim protection and restitution; and<\/span><br data-start=\"8756\" data-end=\"8759\" \/><span style=\"color: #000000;\">d. Submit a time-bound report for further action.<\/span><\/li><\/ol><h2 data-start=\"8818\" data-end=\"8863\"><span style=\"color: #000000;\"><strong data-start=\"8821\" data-end=\"8863\">XIII. PETITIONER\u2019S OFFER OF ASSISTANCE<\/strong><\/span><\/h2><ol start=\"31\"><li data-start=\"8869\" data-end=\"9099\"><span style=\"color: #000000;\">In my capacity as Convenor of Victims Rights Protection Trust, I respectfully offer to place victim data, field-level information and recurring fraud patterns before the authorities, if so permitted, in the larger public interest.<\/span><\/li><\/ol><h2 data-start=\"9106\" data-end=\"9138\"><span style=\"color: #000000;\"><strong data-start=\"9109\" data-end=\"9138\">XIV. BONA FIDES &amp; URGENCY<\/strong><\/span><\/h2><ol start=\"32\"><li data-start=\"9144\" data-end=\"9322\"><span style=\"color: #000000;\">This representation is made bona fide, without personal, political or monetary motive, and solely to prevent continuing constitutional violations affecting thousands of citizens.<\/span><\/li><li data-start=\"9328\" data-end=\"9472\"><span style=\"color: #000000;\">The matter involves public money, systemic failure and ongoing erosion of trust in governance, warranting <strong data-start=\"9434\" data-end=\"9471\">immediate executive consideration<\/strong>.<\/span><\/li><\/ol><h2 data-start=\"9479\" data-end=\"9512\"><span style=\"color: #000000;\"><strong data-start=\"9482\" data-end=\"9512\">XV. FINAL REQUEST &amp; NOTICE<\/strong><\/span><\/h2><ol start=\"34\"><li data-start=\"9518\" data-end=\"9601\"><span style=\"color: #000000;\">I respectfully request a <strong data-start=\"9543\" data-end=\"9588\">reasoned written response at the earliest<\/strong>, indicating:<\/span><\/li><li data-start=\"9606\" data-end=\"9835\"><span style=\"color: #000000;\">Whether the State of Telangana proposes to adopt mandatory, time-bound inter-agency action in economic offences; and<\/span><br data-start=\"9725\" data-end=\"9728\" \/><span style=\"color: #000000;\">b. Whether a uniform institutional protocol will be implemented to prevent recurrence of these failures.<\/span><\/li><li data-start=\"9841\" data-end=\"10098\"><span style=\"color: #000000;\">In the absence of a timely response, I shall be constrained, in discharge of constitutional responsibility, to place these facts before the <strong data-start=\"9981\" data-end=\"10016\">Hon\u2019ble High Court of Telangana<\/strong> by filing a writ petition under Article 226, seeking binding judicial directions.<\/span><\/li><\/ol><h2 data-start=\"10105\" data-end=\"10127\"><span style=\"color: #000000;\"><strong data-start=\"10108\" data-end=\"10127\">XVI.
