Victims Rights Protection Trust (VRPT), Regd.

ఈ Representation కేవలం Dhanwantari Foundation International (DFI) – Crime No.358/2023 కోసం మాత్రమే సమర్పిస్తున్నది కాదు.

రాజ్యాంగంలోని Seventh Schedule, State Listలో Public Order మరియు Police రాష్ట్ర పరిధిలోని అంశాలు.

Mega Financial Crime –

Financial Trail

Asset Trail

Digital Evidence

Mobiles, Computers, Servers, CCTV/DVR, Accounting మరియు Electronic Records.

Legal Proceedings

Bail, Attachment, Writs, Appeals, Property Proceedings మరియు Third-Party Claims.

CASE CONTINUITY PROTOCOL –

Investigating Officers / ACPs / DCPs

  • Case Continuity Officer / Additional Charge / Special Investigation Officer / Advisory Officer
  • Investigation completed, pending accused/witness examination, bank accounts, properties, forensic reports, electronic evidence, Court Orders, attachment proceedings, notices మరియు suspected additional assets వివరాలు handoverలో ఉండాలి.
  • Next Course of Investigation

CCS / EOW

Addl. DGP Level
Mega Financial Crimesపై Overall Supervision
IGP Level
Investigation Monitoring, Inter-Departmental మరియు Inter-Agency Coordination
DCP Level
Senior Operational Supervision
ACP Level
Investigation Supervision మరియు Execution
Special Investigation Teams
Ground-level Investigation, Evidence Collection, Financial & Property Verification

ఈ attachment proceedingsపై Special Court orders తరువాత CRLA Nos.1040, 1041, 1042, 1043, 1044, 1045, 1046 మరియు 1047 of 2025 ద్వారా Hon'ble High Courtలో litigation జరిగింది.

High Court recordsలో Competent Authorityగా Deputy Commissioner of Police, CCS, DD, Hyderabad City పేర్కొనబడింది.

ఈ batch appeals 05-05-2026న dismissed/disposed అయినట్లు case record చూపుతోంది.

అంతటితో litigation ముగియలేదు. Crl.A.No.1182/2025 – Essenn Infra Township Pvt. Ltd. వ్యవహారంలో Crime No.358/2023కు సంబంధించిన Crl.M.P.No.205/2024 order challenge చేయబడింది.

మరోవైపు NCLT Hyderabad Bench-II, Company Application No.04/71/HDB/2025 – Kameswara Rao Mylavarapu v. DFI Nirmaan Pvt.

VRPT కూడా బాధితుల ప్రయోజనాల కోసం WP No.17816/2026 ద్వారా Hon'ble High Courtను ఆశ్రయించి assets identification, tracing, seizure/attachment, bank accounts, investments, alleged proceeds, electronic evidence మరియు తదుపరి recovery processపై directions కోరింది.

ఆ prayerలో Registered Sale Deed Document No.853/2025 dated 10-12-2025, Bejjanki Mandal కూడా ప్రత్యేకంగా ప్రస్తావించబడింది.

EVIDENCE & ASSET PRESERVATION –

  • Mobile Phones
  • Computers
  • Servers
  • Books of Accounts
  • Financial Records
  • Property Records
  • CCTV / DVR Data
  • Relevant Electronic Material

  • Bail Orders
  • Stay Orders
  • Writ Petitions
  • Attachment Appeals
  • Third-Party Claims
  • Interim Directions
  • Final Judgments

1. Court

CCS investigationలో లభించిన material ద్వారా Prevention of Money-Laundering Act (PMLA) పరిధిలో Enforcement Directorate jurisdiction ఆకర్షించే అంశాలు బయటపడితే, సంబంధిత సమాచారం చట్టప్రకారం EDకు పంపే institutional mechanism ఉండాలి.

Revenue Department

Land & Revenue Records

Registration Department

Sale Deeds & Property Transactions

Banks

Accounts & Financial Transactions

Registrar of Companies

Companies & Corporate Records

SFIO

Serious Corporate Fraud Investigation

Income Tax Department

Relevant Financial Information

  1. Addl.
  4. Financial Forensics, Asset Tracing, Banking Investigation, Digital Evidence మరియు Legal Monitoring Teams ఏర్పాటు చేయాలి.
  5. Case Continuity Protocol
  10. Investigation Progress, Money Trail, Forensic Examination, Identified Properties, Attachment Status మరియు Court Ordersను review చేయాలి.
  11. Pending Legal Proceedings, Additional Accused / Assets, Victim Verification మరియు Recovery Statusలను కూడా review చేయాలి.
  12. Crime No.358/2023 – DFI Matterను proposed mechanismకు ఒక immediate pilot / case-studyగా senior-level review చేయాలి.
Crime No.358/2023 – DFI matterను pilot caseగా ఎందుకు పరిశీలించాలి?

ఈ ఒక్క కేసులోనే Crime No.358/2023, అనేక Government Attachment GOs, Special Court proceedings, CRLA Nos.1040–1047/2025, third-party litigation, NCLT proceedings మరియు VRPT ద్వారా దాఖలైన WP No.17816/2026 వంటి అనేక parallel proceedings ఏర్పడ్డాయి.

MOST IMPORTANT – PUBLIC INTEREST – FOR IMMEDIATE CONSIDERATION AND IMPLEMENTATION

అందువల్ల ఈ Representationను “MOST IMPORTANT – PUBLIC INTEREST – FOR IMMEDIATE CONSIDERATION AND IMPLEMENTATION” గా పరిగణించి, Chief Secretary / DGP / Home Department స్థాయిలో ఉన్నతస్థాయి సమావేశం నిర్వహించి CCS/EOWలో పై structural reformsను పరిశీలించి తగిన Government / Departmental Orders జారీ చేయాలని వినమ్రంగా కోరుతున్నాము.

  • Financial & Digital Forensic Support
  • Legal Monitoring Support

Public Interest Representation for Structural Strengthening of Mega Financial Crime Investigations

Regd. No. 209/2025 • Hyderabad
TO The Chief Secretary to Government
Government of Telangana,
Hyderabad.
TO The Director General of Police
Telangana State,
Hyderabad.
TO The Principal Secretary to Government
Home Department,
Government of Telangana, Hyderabad.
SUBJECT: MOST IMPORTANT – FOR IMMEDIATE CONSIDERATION AND IMPLEMENTATION – Request for structural strengthening and reorganisation of the Central Crime Station (CCS) / Economic Offences investigation mechanism for large-scale financial and white-collar crimes by providing Addl. DGP / IGP-level continuous supervision above the existing DCP-level structure; creation of dedicated Financial Crime, Asset Tracing, Digital Evidence and Legal Monitoring Teams; continuity of Investigating Officers even after transfer in identified mega cases; immediate lawful preservation of evidence/assets; and institutional coordination with Enforcement Directorate and other agencies wherever statutory jurisdiction is attracted – Submitted in larger public interest – Reg.

Respected Sir/Madam,

Victims Rights Protection Trust (VRPT), Regd. No.209/2025, respectfully submits this representation in the larger public interest seeking urgent structural strengthening of the investigation mechanism presently available to the Central Crime Station / Economic Offences Wing for dealing with mega financial frauds, deposit frauds, organised white-collar crimes and cases involving hundreds or thousands of victims and hundreds of crores of rupees.

IMPORTANT CLARIFICATION

This representation is not confined to Crime No.358/2023 relating to Dhanwantari Foundation International (DFI).

The DFI matter is referred to only as a practical case study demonstrating the institutional difficulties that can arise when an extraordinarily complex financial crime involving large numbers of victims, multiple companies, properties, bank transactions, electronic records and prolonged litigation has to be investigated within the same administrative structure that is simultaneously handling numerous other serious cases.

Constitutional and Administrative Basis

Under Articles 154 and 162 of the Constitution of India, the executive power of the State extends to matters within the State's legislative competence. “Public Order” and “Police” are Entries 1 and 2 respectively of List II of the Seventh Schedule.

The State therefore possesses the constitutional and administrative competence to organise, strengthen and appropriately supervise its police investigation machinery, subject always to law and judicial control.

Articles 14 and 21 additionally underscore the constitutional importance of fair, non-arbitrary and effective State action where citizens' life, liberty and legal rights are seriously affected.

Modern Mega Financial Crimes Require Specialised Investigation

The nature of modern financial crime has changed substantially. A conventional criminal investigation may concern a limited number of accused persons, witnesses, documents and transactions.

A mega financial crime may involve thousands of investors, hundreds of bank accounts, multiple corporate entities, directors and intermediaries, properties spread across districts and States, electronic communications, mobile phones, computers, accounting systems, registration records, suspected diversion of funds, subsequent alienations, civil proceedings, company proceedings and repeated criminal and constitutional litigation.

Victim & Investor Records

Thousands of victims may have separate claims, investments, receipts and statements.

Banking & Money Trail

Hundreds of accounts and multiple layers of fund movement may require reconstruction.

Property Investigation

Properties may be spread across several districts, States and different ownership structures.

Electronic Evidence

Mobiles, computers, servers, accounting data and digital communications may be critical evidence.

Corporate Structure

Multiple companies, directors, intermediaries and beneficiaries may be involved.

Multiple Court Proceedings

Bail, attachment, writ, company-law and third-party litigation can proceed simultaneously.

The difficulty is compounded by the fact that persons accused in very high-value financial offences may possess substantial financial resources and may engage multiple advocates and professional advisers to challenge notices, attachment proceedings, searches, seizures, summons, custody, property proceedings and other investigative steps before different judicial forums.

Approaching a constitutional Court is unquestionably a legal right and VRPT does not seek curtailment of that right.

The institutional problem arises when the investigating agency does not simultaneously possess sufficient senior supervision, specialised legal assistance, financial forensic capacity and continuity of officers to place the complete factual and legal position before the Court at the earliest opportunity.

In such circumstances, even a sincere Investigating Officer can become overwhelmed. He or she must understand what the victims say, what the accused say, what the bank records establish, how money moved, what properties were purchased, in whose names they stand, whether third-party interests are genuine, what electronic evidence exists, which Court orders govern the investigation and which statutory procedure must be followed.

A financial investigation of this magnitude cannot be understood merely by reading an FIR or a few statements.

Years of transactions may have to be reconstructed before an informed investigative decision can be taken.

Investigation Must Survive Transfers of Officers

The problem becomes more acute because the same ACP/DCP and investigating teams are required to deal with several unrelated economic-offence files.

Each mega case requires sustained study. Frequent administrative transfers then create an additional discontinuity.

An officer who has spent several months understanding thousands of pages of material, the conduct of the parties, the money trail and the history of litigation may be transferred, and the succeeding officer effectively has to restart the learning process.

Valuable institutional knowledge may therefore be lost.
VRPT therefore respectfully proposes a Continuity Principle for identified Mega Financial Crime Cases.

A mega financial crime should be treated as an institutional investigation of the State, not merely as the personal file of whichever ACP/DCP happens to occupy the post at a particular time.

Where an ACP/DCP/Investigating Officer has substantially investigated a notified or identified mega financial crime, transfer from the concerned post should not automatically terminate that officer's responsibility for the case.

Subject to administrative feasibility and the decision of the competent Government/police authority, such officer may continue as a Case Continuity Officer / Additional Charge / Special Investigation Officer for that particular investigation until defined milestones are completed.

  • Completion of major asset tracing.
  • Filing of final or supplementary reports.
  • Completion of attachment documentation.
  • Effective handover certified by a senior supervisory officer.
  • Reasonable transition assistance to the succeeding officer.

Mandatory Digital Case Handover

A mandatory detailed digital handover should record:

  • Pending witnesses and accused persons.
  • Bank accounts and financial transactions.
  • Identified and suspected properties.
  • Pending forensic reports.
  • Court proceedings and attachment status.
  • Pending notices.
  • Existing legal restrictions and Court directions.
  • Suspected additional assets.
  • Next investigative steps.
This single reform can prevent months of investigative knowledge from disappearing every time a transfer occurs.

Permanent Senior-Level Supervision for Mega Financial Crimes

VRPT respectfully submits that a mega financial crime should not remain dependent substantially upon a single DCP-level supervisory structure.

We therefore request consideration of a permanent senior hierarchy in CCS/EOW.

Addl. DGP Level
Overall supervision of Mega Financial Crimes.
IGP Level
Investigation monitoring and inter-agency coordination.
DCP Level
Senior operational supervision.
ACP Level
Operational investigation and execution.
Specialised Teams
Financial Forensics, Asset Tracing, Digital Evidence, Legal Monitoring and Victim Verification.
This proposal is not a criticism of the present DCP, ACP or any individual officer.

On the contrary, it is intended to give those officers the institutional support necessary to deal with cases of extraordinary scale.

DFI CASE – A Practical Example of Why the Reform Is Necessary

Crime No.358/2023 itself illustrates the magnitude involved.

Crime Number
Crime No.358/2023
Investigating Unit
ACP, EOW Team-VI, CCS, DD, Hyderabad
Official CCS Notice
Dated 20-08-2026
Sections
Sections 406 and 420 read with Section 34 IPC and Section 5 of the TSPDFE Act
Victims
More than 2,000 victims as stated in the official investigating agency communication.
Approximate Amount
Approximately ₹516 crores as reflected in the investigating agency's communication.

The material placed before the Hon'ble High Court records the prosecution case that DFI/group entities allegedly collected huge amounts from thousands of victims, many of them senior citizens, through high-return schemes, debentures, preference shares and plot allotments.

The competent authority contended that more than 30 companies were floated and more than ₹500 crore was mobilised.

Government Attachment Orders

  • G.O.Rt.No.473 dated 20-06-2024
  • G.O.Rt.No.474 dated 20-06-2024
  • G.O.Rt.No.541 dated 05-07-2024
  • G.O.Rt.No.542 dated 05-07-2024
  • G.O.Rt.No.561 dated 08-07-2024
  • G.O.Rt.No.665 dated 12-08-2024
  • G.O.Rt.No.258 dated 22-03-2025
  • G.O.Rt.No.259 dated 22-03-2025

These Government Orders subsequently formed part of the litigation before the Hon'ble High Court.

Property Network Reflected in Material Supplied to VRPT

  • Approximately 3,005 sq. yards hospital site at Bagh Amberpet.
  • Approximately Ac.17.46 cents at Narsingabilli, Kasimkota.
  • Properties at Mustabada / Vedurupavuluru.
  • Approximately Ac.29.31 guntas at Kothur / Midgil.
  • Approximately Ac.351-15 guntas at Ananthasagar, Mallaram, Chowdaram and Cherlankireddipalli.
  • Approximately Ac.62.23 guntas at Dumala / Akkapalli, Yellareddypet.
  • Approximately 31,253 sq. yards at Mylardevpally / Rajendranagar.
This demonstrates the geographical and documentary scale of asset tracing required in only one investigation.

Litigation History

The Sessions Judge/Special Judge proceedings culminated in orders dated 29-08-2025 concerning the attachments.

Thereafter, CRLA Nos.1040, 1041, 1042, 1043, 1044, 1045, 1046 and 1047 of 2025 came before the Hon'ble High Court.

The judgment identifies the appeals as arising from the 29-08-2025 Special Court orders and identifies the Competent Authority as the DCP, CCS, DD, Hyderabad.

The available High Court case material records stay applications and additional-material applications against the Special Court's attachment orders.

The batch of appeals was ultimately disposed of/dismissed on 05-05-2026.

The matter did not end there. In Crl.A.No.1182/2025, M/s Essenn Infra Township Pvt. Ltd. separately challenged the order in Crl.M.P.No.205/2024 arising out of the same Crime No.358/2023.

The record itself notes that the CCS investigation against DFI Ventures/group companies was still pending.

Separately, the NCLT Hyderabad Bench-II in Company Application No.04/71/HDB/2025, Kameswara Rao Mylavarapu v. DFI Nirmaan Private Limited pronounced its order on 06-05-2026, allowing the petition concerning redemption of debentures.

This further illustrates how one large financial controversy can simultaneously generate criminal, depositor-protection, company-law and property proceedings before different forums.

VRPT High Court Proceedings

VRPT itself has approached the Hon'ble High Court in WP No.17816/2026 seeking effective action regarding asset identification, tracing, seizure/attachment, bank accounts, investments, alleged proceeds, property transactions, electronic records and eventual recovery.

The prayer specifically refers to Registered Sale Deed Document No.853 of 2025 dated 10-12-2025 at Bejjanki and seeks investigation concerning alleged concealment or alienation during pendency of proceedings.

The petition also seeks Government-supervised auction/recovery measures and records VRPT's claim that it is assisting with statements, records and evidence for more than 1,198 victims.

An investigation may continue for years while attachment proceedings, appeals, third-party claims, company proceedings and fresh property information simultaneously arise.

The investigating system must therefore be stronger than the complexity surrounding the offence.

The Present Legal Framework Already Recognises the Need for Rapid Asset Protection

Section 3 of the Telangana Protection of Depositors of Financial Establishments Act, 1999 expressly empowers the Government, where statutory conditions are satisfied, to pass ad-interim attachment orders over money/property procured from deposits and, where those assets are unavailable or insufficient, over other property of the financial establishment/promoter/manager/member as contemplated by the Act.

Section 4 provides for appointment of the Competent Authority and requires an application to the Special Court for making the ad-interim attachment absolute.

BNSS, 2023 – Relevant Investigative Mechanisms

Section 105
Audio-video recording of search/seizure.
Section 106
Police power to seize property found in circumstances creating suspicion of commission of an offence.
Section 107
Mechanism concerning attachment, forfeiture or restoration of property derived or obtained from criminal activity, subject to statutory process.
Section 185
Investigative search where reasonable grounds exist and obtaining the required thing otherwise would cause undue delay.
VRPT is not asking for uncontrolled police power, arbitrary raids or confiscation without law.

We are asking the Government to create an operational system capable of using the powers already available under law quickly, professionally and under senior supervision, before electronic evidence disappears, funds move or properties acquire multiple layers of transactions.

In serious white-collar cases where the statutory prerequisites for immediate search or seizure exist, there should therefore be no avoidable advance disclosure that defeats the purpose of lawful investigative action.

  • Mobile phones.
  • Computers.
  • Servers.
  • Books of account.
  • Financial records.
  • Property records.
  • Relevant electronic material.

Such material should be preserved at the earliest lawful stage, following applicable BNSS safeguards, judicial requirements and binding Court orders.

Mere registration of an FIR can never justify automatic seizure of every personal asset of an accused.

Assets and evidence must be proceeded against where the applicable statute and evidentiary material legally permit it.

This distinction will make the proposed system both powerful and constitutionally sustainable.

CCS Needs Its Own Permanent Legal and Financial Intelligence Capacity

A major weakness in complicated investigations can arise when the investigating officer must simultaneously investigate the offence and repeatedly prepare responses to sophisticated litigation.

For identified mega financial crimes, CCS/EOW should therefore have a permanent Financial Crime Legal Monitoring Cell, preferably consisting of experienced prosecution/legal officers.

Every mega case should have a continuously maintained digital “COURT ORDER & LITIGATION MATRIX”.
  • Every bail order.
  • Every interim order.
  • Every writ petition.
  • Every attachment challenge.
  • Every third-party claim.
  • Every statutory appeal.
Question 1
What has the Court prohibited?
Question 2
What has the Court permitted?
Question 3
What investigation remains legally open?

A direction relating to one particular notice, person, property or coercive measure should not, through administrative over-caution, be misunderstood as freezing every lawful aspect of an investigation.

Equally, every binding judicial direction must be scrupulously respected.

Senior legal monitoring can achieve both effective investigation and full judicial compliance.

Forensic Accounting and Asset Tracing Cell

A corresponding Forensic Accounting and Asset Tracing Cell should maintain the money trail:

Investor / Depositor  →  Entity / Account  →  Intermediary  →  Ultimate Beneficiary / Property

Revenue, Registration, banking, ROC/company data and digital evidence should be integrated into one investigation matrix rather than remaining in separate files.

CCS–ED and Multi-Agency Coordination

Where material discovered in a CCS investigation discloses facts attracting the statutory jurisdiction of the Enforcement Directorate under the Prevention of Money-Laundering Act , the matter should not remain trapped in departmental compartments.

VRPT respectfully proposes a formal nodal mechanism for exchange of legally shareable information between CCS/EOW and ED and, wherever appropriate, the following agencies:

Registration Department

Property registration and transaction records.

Revenue Department

Land ownership and revenue records.

ROC / SFIO

Corporate entities and serious corporate fraud data.

Income Tax Department

Relevant financial and taxation information.

Banks

Account transactions and fund movement information.

Other Competent Agencies

Any statutory body having lawful jurisdiction over relevant transactions or assets.

Section 66 of PMLA itself contains a statutory information-sharing framework and further provides for sharing information with the concerned agency where material indicates contravention of another law.

We are not requesting merger of the independent statutory jurisdictions of CCS and ED.

Each agency must act only within the powers conferred upon it by law.

What is requested is coordinated parallel action wherever jurisdiction lawfully overlaps so that one agency's evidence, asset information or money-trail intelligence does not remain unknown to another competent agency.

Our Request to the Government

In these circumstances, Victims Rights Protection Trust most respectfully requests the Government of Telangana, the Director General of Police and the Home Department to immediately examine and implement a special institutional framework for Mega Financial Crime Investigations within CCS/EOW.

  1. Establish Addl. DGP-level overall supervision for identified Mega Financial Crime investigations.
  2. Establish IGP-level investigation monitoring and inter-agency coordination.
  3. Continue the existing DCP/ACP operational investigation structure beneath the senior supervisory hierarchy.
  4. Create permanent Financial Forensics capability.
  5. Create a dedicated Asset Tracing Cell.
  6. Create a dedicated Digital Evidence / Digital Forensics Team.
  7. Create a permanent Financial Crime Legal Monitoring Cell.
  8. Introduce a formal Case Continuity Protocol.
  9. Permit, wherever administratively appropriate, a transferred knowledgeable Investigating/Supervisory Officer to continue the identified case in additional-charge, advisory or special-investigation capacity until an effective handover or defined milestone is completed.
  10. Make a detailed Digital Case Handover Report mandatory in notified mega cases.
  11. Classify Mega Financial Crimes separately on objective parameters.
  12. Conduct periodic Addl. DGP-level review of all identified Mega Financial Crime cases.
  13. Record investigation progress, pending forensic work, property identification and attachment status.
  14. Record Court restrictions, pending prosecution steps and victim-recovery position.
  15. Establish formal lawful information-sharing and coordination mechanisms with ED and other competent statutory agencies.
  16. Consider the DFI investigation as an immediate case study for the proposed senior-level review mechanism.

Objective Parameters for Mega Financial Crime Classification

  • Number of victims.
  • Monetary magnitude.
  • Interstate ramifications.
  • Number of entities involved.
  • Number of bank accounts involved.
  • Number and geographical spread of properties.
  • Complexity of the money trail.
  • Litigation burden.
DFI as an Immediate Case Study

The DFI investigation may kindly be taken as an immediate case study for such review, particularly because the official record already demonstrates:

Crime No.358/2023, multiple Government attachment orders, multiple Special Court proceedings, CRLA Nos.1040–1047/2025, separate third-party litigation, NCLT proceedings and continuing VRPT proceedings concerning further asset identification and recovery.

The Issue Raised by VRPT Is Much Larger Than DFI

Today it may be DFI.

Tomorrow it may be another financial establishment, investment scheme, real-estate scheme, corporate entity or organised white-collar network involving thousands of families.

When alleged economic offenders have access to substantial financial resources, sophisticated transactions and prolonged litigation, the State's investigative capacity must be institutionally stronger, legally better prepared and continuously supervised.

A victim who has lost his or her life savings cannot be expected to understand:

Which ACP was transferred?

Which officer presently holds the file?

Which department controls a property?

Which Court proceeding is pending?

Which agency has jurisdiction over a money trail?

Which authority must act on the next recovery step?

That coordination is the responsibility of the State machinery.

MOST IMPORTANT PUBLIC-INTEREST REPRESENTATION

VRPT therefore respectfully submits that this representation may kindly be treated as a MOST IMPORTANT PUBLIC-INTEREST REPRESENTATION REQUIRING IMMEDIATE POLICY AND ADMINISTRATIVE CONSIDERATION, and that a high-level meeting under the Chief Secretary / DGP / Home Department may kindly be convened to examine the strengthening of CCS/EOW on the above lines.

This request is not against any present officer and is not intended to interfere with judicial proceedings or the rights of any accused person.

It is intended to ensure that honest investigating officers are given the hierarchy, manpower, continuity, technology, financial expertise and legal support necessary to perform the enormous responsibility placed upon them.
A strong investigation protects not only victims; it also protects the integrity of the criminal justice system.
Investigation should not weaken merely because the case is large.

Investigation should become stronger because the case is large.

We therefore request immediate consideration and implementation in the larger public interest.

Yours faithfully,
